Plain-English summary (30-second read)
- SEO Genius is in beta. Things will change, break, and surprise you.
- We do not promise uptime, data preservation, or that any feature you see today will exist tomorrow.
- We give you at least 30 days' notice by email before your subscription cost changes during beta.
- Anything you tell us about the product (feedback, bugs, ideas) we can use to improve it, without owing you anything.
- You take part in our aggregated learning loop, which improves the product for everyone. We never share your business name, URLs, or client data. See Section 7.
- Connecting production data is your call. We suggest you do not connect anything you cannot afford to lose.
- We can end your beta access at any time. If we do, you get 14 days to export your data.
- This Addendum sits on top of the Terms of Service. Where the two conflict on a beta-specific matter, this Addendum wins. On matters that are not beta-specific, the Terms of Service control.
- You accept this Addendum at sign-up, together with the Terms of Service. Section 8 says how, and what we record.
1. What "beta" means
The SEO Genius platform (the "Service") is in beta. Beta means:
- The Service is in active development. Features may be added, modified, deprecated, or removed at any time without prior notice.
- The Service may fail, behave unexpectedly, lose data, or surface bugs that affect your work.
- Performance, latency, and reliability are not at the level we aim to deliver at general availability.
- Documentation, dashboards, integrations, and pricing may change as we learn from beta users.
Every account created while the Service is in beta is enrolled in beta. You accept this Beta Addendum (the "Beta Addendum") in addition to the SEO Genius Terms of Service (the "Terms"), at the same moment and in the same way (Section 8). Capitalized terms not defined here have the meaning given in the Terms. Where this Beta Addendum and the Terms conflict on a beta-specific matter, this Beta Addendum controls for as long as your account is enrolled in beta. On any matter that is not beta-specific, the Terms control. This matches the order of precedence in Terms Section 1.4.
2. No SLA, no uptime guarantee
During beta:
- We do not commit to any uptime, response time, support response, or service-level metric.
- We may take the Service offline for maintenance, debugging, or any other reason without prior notice.
- We are not liable to you for any outage, slowdown, error, or downtime, except to the extent a law that cannot be limited by contract requires otherwise.
If we publish an uptime target during beta, that target is informational only and does not create a contractual commitment.
3. Pricing during beta
- Pricing during beta may not reflect the final pricing of the Service at general availability.
- We will give you at least thirty (30) calendar days' advance notice by email before any change to your subscription cost during beta.
- If your beta access is free and we later move you to a paid plan, we will give you at least thirty (30) calendar days' advance notice by email, an affirmative consent step before the first charge, and a chance to cancel before any charge. The pre-purchase disclosure and consent in Terms Section 4.3 apply to that first charge.
- All subscription, billing, and refund terms in Section 4 of the Terms apply to any paid charge incurred during beta, including the pro-rated annual refund window in Section 4.5.
4. Feedback license
If you provide feedback, suggestions, ideas, bug reports, feature requests, screenshots, recordings, or other input about the Service during beta ("Feedback"), you grant Rize Digital a perpetual, irrevocable, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, modify, distribute, and incorporate the Feedback for any purpose, including to improve the Service for all customers. No output of our use of your Feedback will contain your business name, your website URL, or your client identifiers.
We may use anonymized Feedback in marketing, case studies, sales material, and product documentation. We will not publicly attribute Feedback to you by name, business name, or other identifying detail without your prior written consent.
This Section 4 is the controlling statement of the feedback license for Users enrolled in beta. It overlaps with Section 5.5 of the Terms; where the two differ, this Section 4 controls for beta Users. This Section 4 survives the end of your beta enrollment and the termination of the Terms.
5. Data risk during beta
You acknowledge and accept the following risks specific to beta:
- Beta software can lose data, including data you provide or data the Service generates for you.
- Bugs may temporarily show data inside your account to you in the wrong context or, in rare cases, expose data across account boundaries despite our isolation controls. We design against this and will notify you of any such incident.
- Security configurations, sub-processors, and integrations may change more often than they would at general availability.
We will notify you of any incident materially affecting your data as described in Privacy Policy Section 9, and within the timelines required by applicable law. For incidents that trigger California Civil Code § 1798.82, this means notice to affected residents within thirty (30) days of discovery, and notice to the California Attorney General within fifteen (15) calendar days of notifying residents where more than 500 California residents are affected.
Our recommendation. We strongly recommend that you do not connect production systems containing data you cannot afford to lose during beta. Use beta with secondary properties, test workspaces, or sites where a problem would not hurt your business.
You remain solely responsible for backing up your own data outside the Service and for evaluating the suitability of the Service for your business purposes during beta.
6. Beta access can be revoked
- We may revoke or modify your beta access at any time, with or without cause and with or without notice.
- If we revoke your beta access (other than for a material breach of the Terms or this Addendum, or during an active security or legal incident), we will give you at least fourteen (14) calendar days from the date of notice to export your Customer Data from the Service.
- After the export window, your access ends and your Customer Data is deleted in accordance with the retention rules in the Terms (Section 11.3) and the Privacy Policy (Section 7).
If your account converts from beta to a paid, generally available plan, this Beta Addendum no longer applies and the standard Terms govern in full, except that the feedback license in Section 4 survives as stated there.
7. Learning-loop participation during beta
By accepting this Beta Addendum, you take part in the SEO Genius aggregated learning loop. This means:
- We derive aggregated, anonymized patterns from your usage to improve the Service's recommendations and scoring for all customers, including you. This is contractual participation, not a separate opt-in or opt-out, consistent with Terms Section 5.4.
- Your business name, your website URLs, your client identifiers, your competitor lists, and any personally identifying information never leave your tenant boundary in raw form. Only aggregate scoring deltas, action types, vertical (industry) labels, and outcome ranges contribute to the cross-tenant learning set.
- Privacy Policy Section 10 describes the technical controls and the sub-processor list that govern this activity.
If this design conflicts with your data-handling requirements, the Service may not be the right fit for your beta participation.
8. How you accept this Addendum, and the record we keep
You accept this Addendum, together with the Terms of Service, when you create your account. Our sign-up and sign-in pages show a notice directly beneath the button that starts account creation. The notice names the Terms of Service, this Beta Addendum and the Privacy Policy, links to each, and states that clicking that button is your agreement. Clicking it is your acceptance (Terms Section 1.1).
When your account is created, we record on our servers:
- your account identifier;
- the version of the Terms of Service, the Privacy Policy and this Addendum that the notice referred to (this Addendum is version 1.0);
- the time you acted on the notice, in UTC;
- the IP address and browser string of the device you used.
We keep this record for the life of your account, as described in Privacy Policy Section 7. You can ask for a copy at support@seogenius.ai. Changes to this Addendum follow Terms Section 1.3: material changes come with at least thirty (30) days' email notice, and the version you accepted stays available on request after a newer version is published.
